Braden John Karony, the CEO of the bankrupt crypto firm SafeMoon, has been released on bail amidst allegations of involvement in a “multimillion-dollar international fraud scheme.” However, due to financial constraints, he might have to rely on a public defender for his legal representation.
Karony’s legal team, Petrillo Klein & Boxer, has sought to withdraw as his counsel since Jan. 22, citing Karony’s apparent inability to afford private legal representation. This decision followed SafeMoon’s failure to fulfill promises of compensating Karony’s legal fees and subsequent bankruptcy filing.
A magistrate judge appointed a public defender to represent Karony as of Feb. 9 due to his financial situation. Despite objections from his initial legal team, the judge indicated the likelihood of granting the application for a Criminal Justice Act lawyer.
During a Feb. 9 hearing in New York, Magistrate Judge Taryn Merkl granted Karony bail, setting it at $3 million. He was released to his parents’ home in Utah under strict conditions, including electronic monitoring and a prohibition on engaging in crypto promotional activities.
Karony faces charges of securities fraud, wire fraud, and money laundering conspiracy, alongside SafeMoon’s chief technology officer Thomas Smith. The U.S. Securities and Exchange Commission (SEC) has also charged Karony, along with SafeMoon creator Kyle Nagy, with fraud and unregistered securities sales.
Karony’s parents, former Central Intelligence Agency employees, reportedly influenced Merkl’s decision to grant bail. Despite a history of conflict, they expressed support for their son. Prosecutors raised concerns about Karony’s ties to the United Kingdom and access to significant crypto assets, suggesting a flight risk.
Despite his release, Karony faces stern warnings from the judge regarding compliance with bail conditions. Prosecutors remain vigilant about ensuring he does not flee, considering the severity of the charges and the alleged involvement in fraudulent activities.
