The appeal, filed on the last possible day, prevents the names of two bond guarantors for SBF from being revealed until at least Feb. 14.
The names of the two pledges signed by Sam Bankman-Fried’s $250 endorsement will remain under wraps for the time being.
The judge also threw out a deal that would have allowed Bankman-Fried to use certain messaging apps. Lawyers Bankman Fried filed a motion to prevent the publication of the names of the guarantors at the last minute on February 7.
The appeal has no other arguments against the disclosure but will block the enforcement of the order until February 14 to allow another stay to be requested. This appeal is expected after the decision of Jan. 30 after a U.S. district judge. Lewis Kaplan offered joint support from eight major media companies seeking to remove promising brands. At the time, Kaplan said his order would likely have to be recalled due to new conditions.
He said that the arguments of Bankman-Fried’s lawyers and the guarantors “will face such an attack” because the parents of Bankman-Fried are not profitable because the size of each bond is less than, 200,000 $ and 500,000 $. Bankman Fried’s parents – Joseph Bankman and Barbara Fried – were the other two signatories to the bond.
In addition, the judge said the witnesses voluntarily signed individual bonds in the “high-profile criminal complaint” and opened themselves up to public scrutiny. Meanwhile, on February 7, Kaplan rejected a joint agreement between Bankman-Fried’s legal team and lawyers to change bail conditions and allow Bankman-Fried to use certain messaging tools. Kaplan did not give a reason for denying the motion, but added that the matter will be discussed further at a hearing on Feb. 9.
Kaplan ruled on Feb. 1 that Bankman-Fried was prohibited from contacting employees of FTX or Alameda Research, citing the risk of “contacting inappropriate witnesses” after it was revealed that the former CEO contacted past and current employees.
